According to a legal opinion from the Oregon Legislature's legal council, Governor Kulongoski may have exceeded his legal authority by signing Executive Order 07-22, which would deny licenses to Oregon residents based on citizenship.
A copy of the draft legal opinion obtained by the Eugene Register-Guard says the Governor does not have the authority to administratively require that people provide proof they are in the state legally before issuing a driver’s license. Governor Kulongoski is denying he overstepped his authority.
In response to the legal opinion, Sen. Rick Metsger (D-Welches) said, “Regardless of your view on it, the Legislature has to either make this executive order work or come up with an alternate law that negates it.”
